Terms of Use
1. Private beta service ("As Is")
Orbiting is currently provided as a private, invite-only beta for testing and personal group communication. The service is provided strictly on an "as is" and "as available" basis, without warranty of any kind.
We do not guarantee uninterrupted availability, specific uptime, or indefinite data retention. While the system takes regular automated snapshots, members are strongly advised to keep their own copies of important posts and media. A complete portable archive export is available at any time under Settings in the application.
2. Eligibility
You must be at least 13 years old to use Orbiting. By registering or using the service, you represent that you meet this age requirement.
3. Ownership and licenses
You own your content. You retain full ownership of and copyright to all text, images, videos, audio, and other materials you submit or post to Orbiting.
You grant the operator only a non-exclusive, worldwide, royalty-free license to store, process, reproduce, and display your content solely as necessary to operate the service and show your content to the friends and circles you choose to share with. We do not use your content for marketing, advertising, or machine learning training.
4. Acceptable use
You agree to use Orbiting responsibly and lawfully. Specifically, you agree not to:
- Post or transmit any content that is illegal under applicable law.
- Post, distribute, or solicit any Child Sexual Abuse Material (CSAM) or any sexual content involving minors. Such violations will result in immediate termination and referral to law enforcement.
- Harass, stalk, threaten, or abuse other members.
- Distribute stolen or unauthorized goods, malware, viruses, spyware, or unsolicited spam.
- Attempt to probe, scan, or compromise the security of the server, database, or other members' accounts.
- Bypass access controls, authentication checks, or rate limits.
5. Moderation and account termination
Group owners manage membership within their own groups, including issuing invite codes, renewing codes, and removing members.
The operator reserves the right to remove any content or terminate or suspend any account at any time, with or without notice, if we believe these Terms have been violated or if necessary to safeguard the integrity of the service and its members.
6. Changes to the service
Because Orbiting is actively evolving, features may be added, altered, or deprecated at any time. We reserve the right to suspend or discontinue the service at any time with reasonable notice where practicable.
7. Limitation of liability
To the maximum extent permitted by applicable law, Patrick Jarrett and any affiliates or contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, goodwill, or other intangible losses resulting from your access to or inability to access or use the service. In no event shall total liability exceed the amount you paid to use the service (which is $0 during the private beta).
8. Governing law
These Terms shall be governed by and construed in accordance with the laws of the State of [STATE], United States, without regard to its conflict of law principles.
9. Contact
